The State of New York has taken a firm stance against drunk driving by imposing severe penalties for those found guilty of this crime. The penalties can include fines of up to $10,000 along with the suspension or revocation of driving privileges and possibly jail time. With steep penalties in place for the crime, it is important for all drivers to understand what the different DWI violations in the state are.

The zero tolerance law pertains to drivers below the legal age of 21 who drive with a .02 percent blood alcohol content or higher. There is also a chemical test refusal charge for any driver who refuses to undergo a breath, blood or urine test. Either of these charges may result in a license suspension or revocation and civil penalties between $125 and $500.

The state defines a drunk driver as anyone operating a vehicle with a BAC of .08 percent or higher. Those who test at .18 percent or higher may face charges of aggravated driving while intoxicated. This offense carries a maximum penalty of a $2,500 fine, the revocation of driving privileges for one year and one year in jail.

Those people who test between .05 and .07 percent may be charged with driving while ability impaired. The penalties for this include fines of up to $500, 15 days in jail and license suspension for 90 days.

People who are facing drunk driving violations might seek professional assistance when developing their defense. In addition to the steep fines and penalties, the charge remains on an individual’s record. If that same person is accused of DWI again in the next five, 10 or 15 years, then the potential consequences are more serious.
